1. Acceptance of Terms

By accessing or using Kivo Money ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and Kivo Money ("we," "us," or "our"). We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Description of Service

Kivo Money is a portfolio tracking application that helps you monitor your investment portfolio by:

• Accessing your Consolidated Account Statement (CAS) emails from NSDL via Gmail
• Parsing CAS PDF files to extract portfolio data
• Displaying your holdings, transactions, and portfolio analytics
• Providing portfolio tracking and visualization tools

The Service is provided "as is" and "as available" without warranties of any kind.

3. User Accounts and Registration

3.1 Account Requirements

To use the Service, you must:

• Be at least 18 years of age
• Have a valid Google account
• Have a valid PAN (Permanent Account Number) issued by the Income Tax Department of India
• Provide accurate and complete information

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring your Google account security settings are properly configured

4. Acceptable Use

4.1 Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree to use the Service solely for tracking your own investment portfolio.

4.2 Prohibited Conduct

You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any portion of the Service
• Interfere with or disrupt the Service or servers
• Use automated scripts, bots, or scrapers to access the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Upload or transmit viruses, malware, or malicious code
• Impersonate another person or misrepresent your affiliation
• Share your account credentials with others
• Use the Service to track portfolios belonging to other individuals without authorization
• Circumvent rate limits or other security measures

5. Gmail Access and Permissions

5.1 Scope of Access

By granting Gmail access, you authorize us to:

• Search for emails from NSDL (nsdlcas@nsdl.co.in)
• Read metadata (sender, subject, date) of CAS emails
• Download CAS PDF attachments
• Extract portfolio data from these PDFs

5.2 What We Don't Access

We explicitly do NOT:

• Read, access, or store your personal emails
• Access your Gmail contacts
• Send emails on your behalf
• Modify or delete any emails
• Access any data unrelated to CAS statements

5.3 Revoking Access

You may revoke our access to your Gmail at any time through your Google Account permissions page. Revoking access will prevent portfolio synchronization but will not delete your existing data.

6. Data Accuracy and Disclaimer

6.1 Data Source

Portfolio data is extracted from CAS statements provided by NSDL. We make reasonable efforts to accurately parse and display this data, but we cannot guarantee 100% accuracy.

6.2 Not Financial Advice

6.3 Your Responsibility

You are responsible for:

• Verifying the accuracy of displayed data against your official CAS statements
• Making your own investment decisions
• Ensuring your PAN and other details are correct
• Reporting any data discrepancies to us

7. Intellectual Property

7.1 Our Rights

The Service, including all content, features, and functionality (software, text, displays, images, video, audio, design, user interface, trademarks, logos), is owned by Kivo Money and is protected by copyright, trademark, and other intellectual property laws.

7.2 Your Rights

You retain ownership of your portfolio data. By using the Service, you grant us a limited license to process and display your data for the purpose of providing the Service to you.

7.3 Restrictions

You may not:

• Copy, modify, or create derivative works from the Service
• Use our trademarks, logos, or branding without permission
• Remove or alter any copyright notices or proprietary markings

8. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your data.

9. Service Availability and Limitations

9.1 Service Availability

We strive to keep the Service available 24/7, but we do not guarantee uninterrupted access. The Service may be unavailable due to:

• Scheduled maintenance
• Technical issues or outages
• Third-party service disruptions (Google services, etc.)
• Force majeure events

9.2 Rate Limits

To ensure fair usage and protect service quality, we implement rate limits:

• Portfolio sync: Limited to 5 requests per minute
• Portfolio retrieval: Limited to 20 requests per minute

Excessive use may result in temporary account restrictions.

10. Termination

10.1 By You

You may stop using the Service at any time. To delete your account and data, you can:

• Revoke Gmail access via Google Account settings
• Contact us at support@kivomoney.com to request account deletion

10.2 By Us

We may suspend or terminate your access to the Service at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended period of inactivity
• Technical or security reasons

10.3 Effect of Termination

Upon termination:

• Your access to the Service will cease immediately
• Your data will be deleted within 30 days unless required by law
• Sections of these Terms that should survive termination will remain in effect

• Any content or data you provide

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Mumbai, India.

14. Changes to the Service

We reserve the right to:

• Modify, suspend, or discontinue the Service (or any part) at any time
• Change features, functionality, or content
• Update pricing or introduce fees (with notice to users)

We will make reasonable efforts to notify you of significant changes.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Kivo Money regarding the Service.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

The Service may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of third-party sites.
